As such, the employee continued to breathe in asbestos fibers from the old tiles that he regularly removed.

The victim sought mesothelioma benefits offered under his employer’s insurance company via a workers’ compensation claim, but the mesothelioma victim passed away while the claim was still pending. Sadly, this is an unfortunate reminder that mesothelioma survival rates are often low, with less than 1 in 10 pleural mesothelioma patients surviving more than five years after a diagnosis is given.

The employee’s surviving widow then attempted to change the claim to a death benefit for her and the eight children who the mesothelioma victim left behind. However, the insurance company and employer attempted to deny those benefits and engaged in prolonged litigation.

Fortunately, the Supreme Court of Missouri strongly stood by the side of mesothelioma victims and surviving loved ones by ensuring the family received the legal compensation that was owed.
